B iron has the power and authority to enter into and perform this agreement and has the power to manage acquire or dispose of plan assets under erisa section 3 38 and will obtain and or maintain any authorizations permits certifications licenses filings registrations approvals or consents which must be obtained by it from any third party including any governmental authority in connection with this agreement.
Erisa section 3 38. You can delegate most your responsibility to that fiduciary. 3 38 investment manager section 3 38 is an investment manager and by definition is a fiduciary because they take discretion authority and control of the plan s assets. Essentially the 3 38 is responsible for selecting managing monitoring and benchmarking the investment offerings of the plan.
An investment manager is special type of fiduciary one who has been specifically appointed to have full discretionary authority and control to make the actual investment decisions. The key step in that dance is that the investment manager must accept fiduciary responsibility with respect to the plan. The 38th definition in the act erisa section 3 38 is the definition of investment manager.
